High Court Denies Bail to Law Student Impersonating Lawyer
The Gujarat High Court has rejected the anticipatory bail application of a law student accused of impersonating a lawyer and extorting approximately ₹80 lakh from multiple individuals. The court firmly stated that it would not tolerate the tarnishing of the noble legal profession in such a manner. The applicant, Sadhu Falguni Miteshkumar, sought anticipatory bail in connection with an FIR registered at Kadi Police Station in Mahesana district, facing charges under various sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, and Bharatiya Nyaya Sanhita, 2023.
The case alleges that Miteshkumar and other co-accused falsely represented themselves as professional lawyers to defraud complainants of significant sums. During a 'panchnama' conducted at a shop and the applicant's husband's residence, authorities seized a Bar Council enrollment card, case registration documents, police station seals, notary registers, a signboard identifying her as a "Supreme Court Advocate," and other related items, despite her being only a law student. Justice P.M. Raval reviewed the evidence and emphasized the necessity of custodial interrogation to identify other involved individuals and trace the extorted ₹80,00,000. Finding no extraordinary grounds to exercise discretionary jurisdiction, the court denied the application and subsequently rejected a request to challenge the order in the Supreme Court.
